Corporal Billy Ramsundar was charged on Wednesday evening with assault occasioning actual bodily harm against the photographer on September 15th 2017.
On that day in September, De Silva and his Guardian colleague, Sascha Wilson, went to A&V Oil and Gas on Nazim Avenue, as the sought information concerning the company in relation to "fake oil" allegations made by Opposition Leader Kamla Persad-Bissessar.
While there, De Silva was confronted by two men, one of whom claimed to be an officer of the law.
De Silva's glasses were broken during the confrontation, and his camera was destroyed.
Corporal Ramsundar was also charged with malicious damage of a Canon camera valued at US$1,600.
Charges were laid by Superintendent Ruthven Hodge of the Police Complaints Division.
Corporal Ramsundar appeared before a Justice of the Peace on Wednesday and placed on bail of $80,000 after being charged.
