Office of the President clarifies EMA & TRHA Board appointments

The following seeks to clarify the timelines for appointment, by His Excellency Anthony Thomas Aquinas Carmona ORTT, SC, President of the Republic of Trinidad and Tobago, of the Boards of Directors for both the Environmental Management Authority (EMA) and the Tobago Regional Health Authority (TRHA).

Contrary to some media reports,President Carmona has neither refused nor delayed the signing of the Instruments of Revocation and Instruments of Appointment for Membersof the Board of Directors of theEMA. His Excellency has also not refused or delayed the signing of the Instruments of Appointment for Members of the Board of Directors of the TRHA. All of these Instruments were promptly signed off and sealed by His Excellency the President, upon receipt thereof from the Cabinet.

The following is an accurate, reliable account of events concerning the revocation of appointmentof the previous Board of Directors and the appointment ofMembers of the new Board of Directors of the EMA and the appointment of Members of the new Board of Directors of the TRHA.

The Environmental Management Authority(EMA):

(i) On 8 October 2015, the Cabinet revoked the appointments ofMembers of the Board of Directors of the EMA.
(ii) On 24 March 2016-some five (5) months after the revocation of the previous Board- Cabinet approved the appointments of the new Members of the Board of Directors of the EMA.
(iii) A Cabinet memorandum, dated Friday, 3June 2016, was received by the Office of the President on the evening of 6 June 2016 inclusive of the Instruments of Revocation for the previous Board and Instruments of Appointment forMembers of the proposed new Board of Directors. The curricula vitae (CVs) of the proposed new Members were also attached.
(iv) On the said evening of6 June 2016, President Carmona signed the Instruments of Revocationfor the outgoing Board.
(v) On the morning of 7 June 2016, the Instruments of Appointment forMembers of the new Board of Directors of the EMA were signed and sealed by the President.
(vi) On the said morning of7 June 2016, the signed and sealed Instruments were forwarded, as customary, to the requisite Authority.

The Tobago Regional Health Authority (TRHA):

The Office of the President received several calls from the Office of theChief Secretary of the Tobago House of Assembly and other medical professionals, all out of genuine concern, requesting the President to sign off on the Instruments of Appointmentfor Members of the Board of Directors of the Tobago Regional Health Authority (TRHA). TheOffice of the Chief Secretary and the said concerned medical professionals were informed that the Instruments of Appointment had not yet arrived at the Office of the President. The previous Board of the Tobago Regional Health Authority (TRHA), appointed for a period of two years, expiredon 9 March 2016.

(i) On14 April 2016, Cabinet approved the appointments of the new Members of the Board of Directors of the TRHA.
(ii) On 3 June2016- some two (2) months subsequent to Cabinet’s approval- the Office of the President received, for His Excellency’s signature and Seal of Office,the Instruments of Appointment, with curriculavitae(CVs), for the proposed new Members of the Board of Directors of the TRHA.
(vii) On the said 3 June 2016, His Excellency signed, affixed the Seal of the Office and forwarded to the requisite Authority, all the relevant Instruments of Appointment for the new Board of Directors of theTobago Regional Health Authority (TRHA).

It is important to underscore thatthe appointments of these Boards by His Excellency the President were done promptly and efficiently. In making the necessary appointments, the President must ensure that the appointees meet the requirements for qualification and experience set out in the relevant governing legislation. This process is often a short one, because the curricula vitae (CVs) of the proposed appointees to Boards are generally provided to the Office of the President simultaneously with theInstruments of Appointment. The appointments to Boards must always conform and satisfy the requirements for qualification and experience as stipulated in the particular Act.

The Office of the President will continue to efficiently, and without unnecessary delay, carry out its constitutional and statutory duty to, inter alia, make appointments to the relevant Boards. It is hoped that this missive from the Office of the President serves to assist the media and the public at large, in addressing and clarifying any perceived delay, on the part of the Office of the President, relevant to the aforementioned appointments to the Boards of the EMA and the TRHA.
